Miki Project Terms and Conditions.
These are the terms and conditions for the use of the video works distributed by the Miki Project.
Application for Screening
Applicants shall agree to this terms and conditions and submit an application via the dedicated form on the film’s website. Once the individuals or organizations that submitted the form by e-mail are accepted to screen video works, MIKI Project shall lend screening media to the applicants.
Any application submitted by phone shall not be approved.
Applicants are required to fill out the necessary information on the dedicated form in advance to obtain permission for use.
Presentation of details of the screening event
The screening event organizer (applicant) shall provide the following details requested by MIKI Project in advance on the dedicated form.; (i)Title of the event, (ⅱ)Date and time, (ⅲ)Venue name, (ⅳ)Name of the person in charge of operation, (ⅴ)Name of the organizer, (ⅵ)Address and contact information of the representative of the organizer, (ⅶ)any other information required by MIKI Project.
Any individual and organization shall understand that the applicant should be the same entity as the organizer of screening event.
Applicants shall assume that any application submitted on behalf of the event organizer will not be approved.
Confirmation and Adjustment of Screening Dates
Applicants shall understand that MIKI project may request the adjustment of screening dates when there is another individual or organization that has already applied for or received permission for a screening in a nearby date or area.
In such cases, the organizer shall be responsible for any expenses incurred for the change of date. These expenses cannot be charged to the MIKI Project.
The screening date shall be set at least one month ahead of the date of application.
Announcement of Screening Dates and Times
Applicants shall announce the date and time of the screening only after the payment of the screening fee has been made and MIKI Project sends an acceptance e-mail.
Simply submitting the application and making a remittance from the organizer shall not mean gaining acceptance of holding the screening.
Purpose of holding screenings
MIKI Project may refrain from lending the screening discs if the purpose of holding screenings includes the following content; (i)Solicitation or sales activities at the screening venue, (ⅱ)events and film screenings that are not related to the watching films, such as solicitation for membership in religious or school groups, sales of goods and all other types of sales, or any activity as an employment agency.(ⅲ)Enforcing participants to attend other events after screening the film.(ⅳ)Critical words or actions regarding the content of the film during the film screening event.
Applicants shall understand that MIKI project shall not lend screening media to the organizers and related parties anymore when these unacceptable behavior is observed.
Copyrights
The copyright of the video works is owned by MIKI Project.
Only the applicant who has agreed to the terms and conditions has the right to show the film.
The organizer, who has obtained permission for the application, shall agree to assume the obligation for any damage that is caused to MIKI project, such as suspension of the use, collection and delivery of the video work because the organizer behaves in the following manner.
- The organizer uses the borrowed video work beyond the scope of the intended use of the content in the accepted application.
- The organizer resells, distributes, transfers, subleases, or transmits the video work to a third party.
Any duplication, reproduction, filming (both moving and still images), or alteration of the screening media is strictly prohibited.
If the organizer duplicates or shows the screening media without permission, the MIKI Project shall file a claim for damages or compensation equivalent to the maximum amount of the screening fee, and will consider criminal charges and civil lawsuits against the organizer.
In case of illegal duplication, 22,000 yen per day shall be added to the regular screening fee during the period from the scheduled screening date to the day when the duplicate is delivered to the MIKI Project.
Image Rights
In order to protect the image rights of the performers in this film, the organizer shall understand to prohibit the participants of the screenings, the management and assistants from taking any photographs (both moving and still images) of the film, including for personal use.
The copyright of the flyers and posters of this film is owned by MIKI Project. Applicants shall acknowledge that the performers in the photographs have image rights.
MIKI Project shall not accept any scanning or processing the flyers, and posting documents and photos from the flyers on the Internet without permission.
If any of the above is violated, Miki Project or the performers of this production shall demand that the organizer, photographer, or owner of the photographed material remove or injunct the material, or compensate for damages.
Handling of Media for Screening
Applicants shall take sufficient care of their screening media to prevent accidents such as loss or damage.
In the event of loss or damage, the applicant may be charged a flat fee of 50,000 yen (including tax).
Purpose of screening media
Applicants shall understand that media for screening may not be used for purposes that are offensive to public order and morals, illegal, or otherwise unacceptable to the MIKI Project.
Screening Report
Applicants shall report the number of people (number of public viewers and staff members, which excludes organizers and co-organizers) within 7 days after the screening.
- Organizers shall ship media for screening within 7 days after the screening.
- The organizer is responsible for using a shipping method that can be managed by a tracking number and for the shipping costs.
- If the screening media is not returned by the due date, MIKI project shall take appropriate legal action.
- In the event of a significant delay in return, a charge of 22,000 yen per day shall be added to the regular screening fee from the day during the period from the scheduled return date to the day when the media is returned.
Screening Fee and Shipping Charges
The organizer shall pay for all other items received, such as brochures, flyers, etc., and their shipping costs, in accordance with the screening fee rules set by the MIKI Project. Applicants shall cover the shipping cost for delivery as well as returning the DVD.
The organizer shall pay the invoice issued by MIKI Project by bank transfer or PayPal to the bank account designated by MIKI Project within one week of receipt of the invoice. Bank transfer fees are the responsibility of the organizer.
Cancellation Fees
In the event that a screening is cancelled, MIKI Project shall charge a cancellation fee to cover the costs incurred for the preparation up to that point, which includes reception, shipping, and announcement.
From the date of reservation to 31 days prior to the scheduled screening date: 10% of screening fee
30 to 15 days prior to the scheduled screening date: 30% of screening fee
14 to 8 days prior to the scheduled event: 50% of screening fee
7 days prior to the scheduled date: 100% of screening fee
Applicants shall assume that in the case of cancellation of the event to which director MIKI has been invited, MIKI project also charges each cancellation fee of screening and appearance.
Cancellation Fee for Director’s Appearance
From the date of reservation to 31 days before the scheduled date: 50% of the director’s performance fee
Less than 30 days prior to the scheduled date: 100% of the director’s performance fee
If MIKI Project receives two or more cancellation notices from the same organizer, we shall refrain from accepting an application of screening any more.
f a typhoon or other natural disaster makes it difficult to hold the screening, no cancellation fee will be charged. Organizers may choose to cancel or postpone the screening.
Natural disasters include typhoon storms, torrential rains, heavy snowfall, floods, storm surges, earthquakes, tsunamis, and volcanic eruptions.
MIKI Project shall acknowledge that the above-mentioned natural disasters may lead to cancellation of the screening event because there could be some risks including the case that transportation is severely affected, and/or going outside invites danger, and/or there is concern of building collapse.
Applicants shall contact the Miki Project Office immediately if it found that it’s inevitable to cancel or postpone the event on the day or before the screening.
However, cancellation or postponement cannot be accepted in the following cases ; (ⅰ)If a natural disaster occurs before the screening, but the damage is not considered severe enough to cancel the screening. (ⅱ)If a natural disaster occurs after the screening.
Miki Project reserves the right to refuse permission for the use of the video work to an applicant at its own discretion. In such a case, Miki Project shall not be obligated to disclose the reason for its decision to the organizer.
Miki Project and the applicant agree that the Ise Summary Court shall have exclusive jurisdiction as the court of first instance for any disputes between the parties related to this agreement.
